With Whom does the Government and its Agencies Work, with the Ummah or with its Enemies?!
(Translated)

After Hizb ut Tahrir / Wilayah Sudan held a stand in the courtyard of the Grand Mosque in Al-Ubayyid, the capital of North Kordofan State, Ustaadh Al-Nadhir Muhammad Hussein, a member of Hizb ut Tahrir, addressed the crowd following Friday prayers on 27 Rajab 1447 AH, corresponding to 16/01/2026, on the occasion of the 105th lunar year since the destruction of the Islamic Khilafah (Caliphate), reminding the attendees of the crown of obligations, the Khilafah and the obligation to work to establish it, the security services arrested four young men from Hizb ut Tahrir, then released them on Sunday, 18/01/2026.

Then, on Tuesday, January 27, 2026, they were summoned again, and charges were filed against them under Article 69 of the Sudanese Penal Code (disturbing public peace and tranquility). Their lawyer submitted a request for bail or dismissal of the charges, but the prosecution ordered a reinvestigation of the men. Following the reinvestigation, the prosecution added three new articles to the charges against the men: Articles 63, 67, and 126 of the Penal Code, and they were detained for ten days.

We in Hizb ut Tahrir / Wilayah Sudan issued a press release on January 28, 2026, entitled: “Has the Call to Islam and its Implementation Become a Disruption of Public Peace and Tranquility?!” In it, we denounced this strange and bizarre behavior by the government and its agencies towards the campaign for the call to Islam! And now the government persists in fighting the campaign, fabricating charges against them that would astonish even the enemies of Islam, let alone its friends! Article 63 states: “Whoever calls for, publishes, or promotes any call to oppose the public authority through violence or criminal force shall be punished by imprisonment for a period not exceeding three years, or by a fine, or by both.”

Article 67 states: Anyone participating in a gathering of five or more persons shall be considered to have committed the crime of rioting if the gathering displays force, uses force, intimidation, or violence, and if its predominant intent is to achieve any of the following: a) Resisting the implementation of any law or legal procedure. b) Committing the crime of criminal damage, criminal obstruction, or any other crime. c) Exercising any existing or claimed right in a manner likely to disturb the public peace. d) Compelling any person to do what the law does not require of them, or to refrain from doing what the law permits them to do.

Article 126 states: Anyone who declares that a person, or a sect or group of people, has apostatized from their religion or beliefs, or publicly declares that such person, sect or group to be an infidel, thereby making their blood forfeit, shall be punished by imprisonment for a period not exceeding ten years, or by a fine, or by both penalties.

Anyone familiar with Hizb ut Tahrir will be surprised and astonished, for they know it is a political party whose ideology is Islam, striving to revive an Islamic way of life by establishing the Khilafah according to the methodology of the Prophethood. It does not engage in any material action, but rather in intellectual struggle and political activism, but in emulation of the beloved Prophet Muhammad (saw), the role model and exemplar, who did not undertake any material action before the establishment of the state.

We have the right to ask: With whom does this government and its institutions work? With the Ummah and its crucial cause: The implementation of Islam under the second Khilafah Rashidah (rightly guided Caliphate), following the methodology of the Prophethood? Or with the enemies of the Ummah who are waging war against Islam and those who spread its message? Allah Almighty says:

[إِنَّمَا يَفْتَرِى الْكَذِبَ الَّذِينَ لَا يُؤْمِنُونَ بِآيَاتِ اللَّهِ وَأُولَئِكَ هُمُ الْكَاذِبُونَ]

“No one fabricates lies except those who disbelieve in Allah’s revelations, and it is they who are the ˹true˺ liars.” [An-Nahl 16:105].
