News Right Now: Absurd Judgment
The primary court of Kandahar, Afghanistan has issued a verdict announcing that 15 dawah carriers of Hizb ut Tahrir will be imprisoned indefinitely until and unless they express remorse for calling for the establishment of Khilafah upon the method of the Prophethood. In a country that claims to adhere to Shariah laws, this verdict exposes the regime as yet another led by Muslim rulers who do not hold Allah (swt's) laws as superior to all others.
Detaining these brothers who are calling for the return of a system which will bring light and peace to the entirety of mankind portrays a dangerous misunderstanding on the part of the Afghan regime. The Islamic system is the system our beloved Prophet Muhammad (saw) shed blood for to establish it as a mercy for all of mankind. Some of the best Muslims in history, his Sahabah, fought many battles where the odds were heavily against their favor. Does the Afghan regime not remember the famous Battle of Badr where the Muslims, new and having just established an Islamic government in Madinah, fought the Kuffar, 1 Muslim to 3 kuffar and experienced an overwhelming victory in addition to the death of Abu Jahl with the permission of Allah (swt)? Does the Afghan regime not recall the torture Bilal, Sumaiyyah, Yasir, and so many other sahabah, radiallahuanhum, suffered and endured to push Allah (swt) message forward? The Afghan regime has joined those colonialist governments who arrogantly arrest innocent people who call for the return of Islam, out of fear of being eliminated from their position of power by a message of pure truth and light. Allah (swt) says in Surah Saff, ayah 8:
[يُرِيدُونَ لِيُطْفِـُٔوا۟ نُورَ ٱللَّهِ بِأَفْوَٰهِهِمْ وَٱللَّهُ مُتِمُّ نُورِهِۦ وَلَوْ كَرِهَ ٱلْكَـٰفِرُونَ]
"they want to extinguish the light of Allāh with their mouths, but Allāh will perfect His light, although the disbelievers dislike it."
Indeed Allah swt protects and ensures the success of those of his servants who righteously enjoin good and forbid evil as he commanded of the entirety of our Ummah in Surah Aali-Imran, verse 104:
[وَلۡتَكُن مِّنكُمۡ أُمَّةࣱ یَدۡعُونَ إِلَى ٱلۡخَیۡرِ وَیَأۡمُرُونَ بِٱلۡمَعۡرُوفِ وَیَنۡهَوۡنَ عَنِ ٱلۡمُنكَرِۚ وَأُو۟لَـٰۤىِٕكَ هُمُ ٱلۡمُفۡلِحُونَ]
"And let there be among you [a] people inviting to the good [and] enjoining the right, and forbidding from the wrong, and those - they (are) the successful ones."
For those listening, I urge you to question the validity of any semblance of reasoning behind this verdict. What law based on Islamic jurisprudence could have possibly made the act of arresting and indefinitely imprisoning brothers who are calling for the unification of the Ummah under the Khilafah Rashidah permissible? The court placed the condition of these brothers' release upon repentance for giving Dawah. In Shariah, repentance means to turn away from a sin and ask for forgiveness. How does it make sense to force these Shabab to ask for forgiveness for an act that is obligatory for every member of the ummah? The prisoners of Afghanistan are subjected to brutal forms of torture daily, including methods like waterboarding, suffocation, severe beatings, and more. The jurisprudential opinion of the majority of Islamic schools of thought stress the prohibition of torturing the criminals, let alone the torture of Dawah carriers. So how can this verdict hold any Islamic legitimacy in a court that claims to enforce shariah law?
To the sincere officials within the Afghan regime, we remind you of the warning of Allah (swt) in Surat Al Buruj, Ayah 10, where HE says:
[إِنَّ الَّذِينَ فَتَنُوا الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ ثُمَّ لَمْ يَتُوبُوا فَلَهُمْ عَذَابُ جَهَنَّمَوَلَهُمْ عَذَابُ الْحَرِيقِ]
"For those who persecute believing men and women, and do not repent afterwards, there will be the torment of Hell and burning."
You have the power to reverse this verdict and bring justice to these brothers because you have Allah (swt) on your side. HE is testing you with a choice: to sit idly and watch as your brothers are nonsensically tortured for the honorable acts of giving Dawah, or stand strong in the face of oppression with your Iman in Allah’s word unwavering. We urge you to take this stand, pass this test, and free the shebab from their wrongful imprisonment for the good of the Ummah. The Afghanistan regime may have made this verdict with fear that any other party would threaten their existence as a political authority. We remind the regime that such fear and animosity should only be directed towards the Kuffar- not those who are working to establish Allah’s system as the supreme law. Political parties which call for Islam are vital towards holding the current regime accountable to ensure the entire state is earning the pleasure of Allah (swt). Stamping out such parties only hands tools to Shaytan to make more room for fitnah and corruption to grow within the state. The international order thrives on using corruption to its material benefit and advantage, establishing man made laws that give people the illusion of freedom while inconspicuously shackling and exploiting them with laws that benefit the rich and powerful. We sincerely urge you to detach yourselves from the same kuffar mentalities which Shaytan has captured the international order with, to use true Islamic jurisprudence to push this Ummah towards a path that is pleasing to Allah (swt), and to free these sincere brothers, who are soldiers of Allah (swt) calling for the establishment of the Caliphate upon the method of the Prophethood.
